Divorce in Florida

Every state has it’s own laws regarding grounds for divorce.  For Florida residents it is important to know that Florida is a no fault state. This means you don’t need to allege that your spouse engaged in bad behavior (such as adultery) in order to obtain a divorce. Either party can file for divorce by simply alleging that the marriage is “irretrievably broken,” which is just a way of saying the couple can’t get along anymore. However, a court may consider allegations of “fault” or wrongdoing when deciding how much alimony to award.

When going through the divorce process there are several factors to consider including alimony, property division, child support, child custody and visitation (when children are involved).  These issues can be very complex and you will be no doubt filled with high emotion.  It is important to seek legal representation when facing these issues.  Finding legal representation not only protects your future but it gives you a level, non emotional guide who can help you look past the emotion and make sound decisions.
